New Administrative Judge of the Criminal Term

New York Court of Appeals

On January 23, 2017, New York Court of Appeals Chief Judge, Janet DiFiore, appointed Ellen Biben as Administrative Judge of the Criminal Term of the Supreme Court, New York County. Biben replaced former Judge Michael Obus, who had overseen the court that is responsible for the adjudication of all felony prosecutions in Manhattan for the last eight years. Due to “philosophical differences” with the Office of Court Administration, Obus did not have his one-year appointment renewed; he will still remain on the bench. Chief Administrative Judge Marks said in a statement that Biben “has distinguished herself as an energetic leader who thrives on new challenges." View profile ↓

Description: The Court of Appeals, which is New York's court of last resort, consists of a chief judge and six associate judges who are appointed to fourteen-year terms. Judges are appointed by the Governor with the advice and consent of the New York State Senate from a list of candidates provided by the Commission on Judicial Nominations. The Court of Appeals hears both civil and criminal appeals. The jurisdiction of the Court is limited by Section 3 of Article VI of the New York Constitution to the review of questions of law, except in a criminal case in which the judgment includes a penalty of death or a case in which the Appellate Division of the Supreme Court, in reversing or modifying a final or interlocutory judgment or order, finds new facts and a final judgment or order is entered pursuant to that finding. An appeal may be taken directly from the court of original jurisdiction to the Court of Appeals from a final judgment or order in a civil action or proceeding in which the only question is the constitutionality of a state or federal statute. The Court also reviews determinations of the New York State Commission on Judicial Conduct.
